TERMS OF SERVICE

In consideration of being permitted to participate in any way in any of the services or events provided by Sacred Space Spa and Retreat and it’s owners Laurie Jo Colvin and Jay Colvin, I understand & agree to the following:

I understand that therapeutic services (included but not limited to sound therapies, massage and body work, Reiki and other energy healing modalities, yoga, and spiritual rituals) at the Sacred Space Spa and Retreat may include physical movements, as well as an opportunity for relaxation, stress reduction and relief of muscular tension. I understand and agree to receive information, instruction and therapeutic services including verbal and possibly light physical touch by service providers and instructors, and I agree to the foregoing. As is the case with any physical activity, the risk of injury, even serious, disabling or death is always present. It is my responsibility to consult with a physician prior to my participation in any activity offered at Sacred Space Spa and Retreat. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in any of the activities offered. I agree to take full responsibility for any risks, loss, claim, injury, damage or liability known or unknown, which I might incur as a result of participating in any services.

I knowingly, voluntarily, and expressly agree to accept full responsibility and assume all risk for my participation in any activity, the use of any apparatus or appliance, and the use of the facility owned and operated by the Sacred Space Spa and Retreat including its owners, managers, staff, lessees of the premises (herein referred to as the “Releasees”). I further and forever hold the Releasees harmless from any and all loss, claim, injury, damage, death or liability sustained or incurred from any activity on or off the premises which may be caused by an act of omission, whether negligent, intentional or otherwise of an Independent contractor, representative, or agent of Sacred Space Spa and Retreat. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

Any dispute arising from this agreement shall be submitted to binding arbitration in Nevada County, California through Judicial Arbitration and Mediation Services applying the laws of the State of California. Each of the undersigned further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of California and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.

I understand that pictures may be taken throughout group classes. I authorize the Releasees to use these photos for any and all advertising purposes. I agree that the Releasees are in no way responsible for the safekeeping of my personal belongings while I attend a session or class.

On behalf of the participant and individually, the undersigned partner(s) and/or legal guardian(s) for the minor participant execute this Release and Waiver of Liability. If, despite this release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his behalf, and hold them harmless.

I have read this Release and Waiver of Liability, assumption of risk and indemnity agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and voluntarily without inducement, assurance, or guarantee being made to me. My agreement and signature below constitutes my full acceptance and understanding of this waiver and unconditional release of all liability to the greater extent allowed by law.
